This guide provides essential information on registering, managing, and troubleshooting both State Income Tax (SIT) and State Unemployment Insurance (SUI) accounts in New Mexico.

However, the tax rate is 1.15% for new employers in the construction industry and 1.16% for new employers in the agriculture, forestry, fishing, and hunting industry.

Most companies in New Mexico must start paying unemployment insurance tax (and can register)once they have:
- Paid $450 in wages during a calendar quarter or;
- Had at least one New Mexico employee working for any part of the week, for 20 or more different weeks during a calendar year.
Your business type (general, non-profit, etc) can impact when the company is responsible for paying this tax. We recommend contacting the agency to confirm when the company will be liable.
Running payroll before you're required to pay unemployment tax
If you need to run payroll but have not met the unemployment tax requirements yet, Gusto lets you do so. For now, enter the "new employer rate" for New Mexico in GoCo. Update the rate once you get your official rate in GoCo by following these steps in our help article How to Access Embedded Payroll Tax Settings

Third-Party Administrator (TPA):
- TPA Required for SIT: YES
- Log into yourTAP account.
- In the upper-right corner, selectManage My Profile.
- SelectMore Profile Options…
- Under "Access", selectManage Third Party Access.
From this menu, you will see the following options.
Allowed: Yes
Default Access: Standard
Default Account Access: File Returns and Make Payments
If the settings above read differently, change them to match.
- Click Add to prompt the "Grant 3rd Party Access" flow.
- On the instructions page, click Next.
- Enter Gusto's logon: compliance@zenpayroll.com.
- Select Add/Edit Account Access.
Enter the following:
Account type: Wage Withholding
Access level: File Returns and Make Payments
- Click Add.
Submit your request and upload your authorization form, either:
Your Federal 8655 form completed during GoCo Embedded Payroll onboarding, or;
Form ACD-31102 (Tax Information Authorization Tax Disclosure)
If we cannot view your account, GoCo’s Embedded Payroll Partner Gusto may ask you for some more info, like: zip code, last payment amount, or most recent total tax due.

- Process: Contact the New Mexico Taxation and Revenue Department for account updates.
